Summary Florida Statute 95.361 (2) provides that, even if a street or road in the City was not constructed by the City, if the road has been regularly maintained or repaired for the immediate past seven years by the City, the road or street shall be deemed dedicated to the public to the extent of the width that has actually has been maintained or repaired for the seven year period, whether or not the street has been formally established as a public roadway.
Section (3) of the same statute establishes that the filing of a map in the office of the clerk of circuit court in the county where the street or road is located shall be prima facia evidence of ownership of the street or road by the City.
The recorded map must contain the certifications of the Mayor and City Clerk and the common practice is to include the certificate of a licensed surveyor and a City Public Works official.
Detailed surveys and maps for the two identified parcels have been prepared and presently the signatures and certifications of City Public Services Director Rodolfo Valladares, P.E. and surveyor Mike Harbert are affixed. The streets are described as:
Parcel I
NW 138th Avenue, from County Road 2054 (Peggy Road) to Northwest 173rd Street (County Road 235 A), in the City of Alachua (Map Attached).
Parcel II
Northwest 157th Street, from 118th Avenue to Northwest County Road 235, in the City of Alachua (Map Attached)
Both street sections are a functioning and important part of the City infrastructure and planned for future paving to better support traffic flow, emergency services and economic development.
