Summary The City Commission, on December 13, 2010, adopted Ordinance 11 02 in order to vacate a portion of NW 158 Lane that was acquired by the City by deed from the Florida Department of Transportation in October of 1977. The vacated portion of NW 158th Lane is a segment approximately 2150 feet in length beginning at the right of way line on the east side of I-75, located south of and parallel to US 441, and running east to stop at a point where there is a planned new entrance to US 441.
The conveyance of vacated right of way by the City to adjoining property owners called for in Ordinance 11 02 did not occur due to the uncertainty in the plans for development of adjacent property and the lack of need for investment in utility infrastructure to serve the larger area surrounding the I-75/US 441 interchange and property west of the interstate highway.
The economy has recently improved and infrastructure improvements are required to meet now existing and future needs to serve both residential and commercial development.
The Florida Department of Transportation (FDOT), since the adoption of Ordinance 11 02, has made improvements to access to the US 441 to I-75 interchange that have blocked passage under the interstate of NW 158th Lane traffic, thereby blocking a pathway contemplated and a part of Ordinance 11 02. However, FDOT, during the interchange improvements, constructed a lighted "Park and Ride" parking area thus eliminating the need for the development of a similar facility contemplated and included in the language of Ordinance 11 02.
The land rights required to implement the updated utility infrastructure plan that has evolved over the nearly six years since the adoption of Ordinance 11 02 have been acquired and are contained in the documents attached as a part of the presentation of Ordinance 17-04. The language to convey the portion of NW 158th Lane contained in Ordinance 11 02 has been amended and restated to comport with and meet the needs of the public and better serve the adjoining land owners.
All related easements and the one deed to the City for a lift station site were donated by the property owners.
