SUBJECT:  Pilot Forest Lot 18 Final Plat: A request by George F. Young, Inc., applicant and agent for Paul Elkins, property owner, for consideration of the replat of a ±.51 acre subject property located in the Pilot Forest subdivision. Tax Parcel No. 03980-003-018 (Quasi-Judicial Hearing)

RECOMMENDED ACTION:

Staff recommends that the City Commission approve the application by making the following motion:

 

Based upon the competent substantial evidence presented at this hearing, this presentation before the Commission, and Staff’s recommendation, the City Commission find the application to be consistent with the City of Alachua Comprehensive Plan and in compliance with the Land Development Regulations, and:

 

  1. Approve the Final Plat of Lot 18 of the Pilot Forest Subdivision;
  2. Authorize the Mayor to sign the Final Plat acknowledging the Commission's approval; and,
  3. Authorize the City Attorney to sign the Final Plat approving their legal form and sufficiency

 

Summary

This application is a request by Stacy Hall, PSM, of George F. Young, Inc., applicant and agent for Paul Elkins, property owner, for the approval of a final plat to revise a single lot within an existing subdivision (replat). Per Section 2.4.10 (F)(1)(b) of the City's Land Development Regulations (LDRs), revisions to single lots within an existing platted subdivision are considered to be minor subdivisions, therefore they proceed directly to the final plat approval stage.

 

The subject property currently has one single family residential structure. The subject property is located east of County Road 235, west of NW 157th Street, along  NW 118th Place at 16025 NW 118th Place in the Pilot Forest Subdivision.The proposed replat would not create any additional lots; it is intended to modify the building setbacks as the existing residence is encroaching on the setbacks as created by the approved subdivision plat (Plat Book J, Page 92; approved March 19, 1979). The proposed setbacks conform to current dimensional standards set forth in Article 5 of the City's LDRs. While the encroachment has rendered the building to be a non-conforming structure, which is permitted to continue to exist under Article 8 of the City's LDRs, real estate lenders have refused to issue any mortgages for the property because of the encroachment. According to the current property owner, this has made their property unsalable. The City did not initiate or require the initiation of this application.

 

The current platted building setbacks for this property are as follows: front, 40 feet; sides, 10 feet; rear, 40 feet. The proposed building setbacks are: front, 40 feet; sides, 15 feet; rear, 20 feet. While the rear building setback will decrease by 20 feet, the side building setback will increase by 5 feet. The size of the building envelope (11,200 square feet) will not change as a result of this replat.

 

At the September 13, 2016 meeting, the Planning and Zoning Board voted 3-0 in favor of forwarding this application to the City Commission with a recommendation to approve.
