SUBJECT:  F.S.S. 164 Extension of Time Requirements for Mediation with Alachua County

RECOMMENDED ACTION:

Approve the Agreement Between Alachua County and City of Alachua to Extend Time Requirements for Mediation and authorize the Mayor to sign it.

 

Summary

The City of Alachua is engaged in the Florida Governmental Conflict Resolution Act (Florida Statutes Chapter 164) with Alachua County relating to two (2) complaints filed against the City regarding Ordinance 15 03.

 

Chapter 164 of the Florida Statutes requires that mediation take place within 14 days of when the last entity approves a mediator.  Alachua County approved mediator Carlos Alvarez on Tuesday, July 14, 2015.  Therefore, mediation would have to take place on or before July 27.  However, the statute also allows deadlines to be extended by a joint written agreement.  Alachua County has approved an extension of time for the mediation until the date already agreed upon by the City Commission, August 18, 2015.  Alachua County has provided the “Agreement Between Alachua County and City of Alachua to Extend Time Requirements for Mediation” to the City for the Commission’s approval.

 

The City attorney has reviewed it and recommends approval.
