SUBJECT:  Duke Energy Temporary Use of Vacant City Property

RECOMMENDED ACTION:

Approve the Temporary Access and Construction Yard Permit agreement between the City and Duke Energy and direct and authorized the Mayor to sign the Agreement.

 

Summary

The City has owned Tax Parcel 05949-008-000 (8.21 acres) contiguous to and immediately south of the electric substation located at the southern terminus of Cellon Creek Blvd. since April 13, 1987 (see the attached use agreement and included map).

 

The property is little used by the City and is vacant except for two power poles used only for Electric Department training purposes.There are no City plans to utilize the described property for other activity in the foreseeable future.

 

Duke Energy Florida, L.L.C. plans to do considerable work maintaining and rebuilding transmission and distribution lines in the area of the described City property for the next two years and requires space for a temporary construction yard to store materials. Negotiations between the City and Duke Energy have produced the attached proposed agreement for the non exclusive permitted use of the vacant City Property for a term of 25 months at $2,500 per month. The agreement calls for a $62,500

payment to the City ten days after City acceptance and also provides for an extension of up to six additional months at the same monthly rate.

 

Standard conditions are included in the agreement such as protection of the City against liability claims, orderly, safe and sightly use and restoration at the end of the agreement term.
