Summary The City of Alachua purchases wholesale electric service from Gainesville Regional Utilities (GRU) via contract, last amended on Nov. 22, 2010. The terms of the contract provide for a Purchaser's Option to Reopen Pricing that the City has exercised effective Jan. 1, 2016. The City and GRU have a 75-day period in which to work together and negotiate pricing to the mutual satisfaction of both parties. If mutual pricing is not met during the 75-day period, the City has the option to notify GRU of termination of the contract, effective no less than 12 months from the date of the termination notice.
The City has received a request from GRU to execute a Confidentiality and Nondisclosure Agreement for purposes of negotiations. GRU has indicated the negotiations will constitute trade secrets, pursuant to Florida Statutes 812.081 and 812.045. Accordingly, pursuant to Florida Statutes 815.045, such trade secrets are confidential and exempt from the public records law.
The City Administration and the City Attorney have reviewed the proposed Agreement and find it acceptable. |
