Summary Duke Energy Florida, L.L.C., is in the process of rebuilding and upgrading its existing transmission facilities that traverse the municipal limits of the City of Alachua. Duke Energy requires the use of temporary equipment and material storage facilities through and including December 31, 2017.
Duke and the City entered into an agreement for nonexclusive use of an 8.71 acre City parcel for the
described use on 11-23-15 and City was paid $62,500 through the 12-31-17 use period. Duke Energy has
since determined that it requires an additional parcel of approximately 40 acres for temporary storage to
support the transmission facility work.
Staff identified City-owned vacant and unused Tax ID parcel 03929-002-000 shown on Exhibit A of the attached Temporary Access and Construction Yard Permit. Negotiations were held with Duke Energy and the attached Temporary Access and Construction Yard Permit was negotiated for a term April 11, 2016 to December 31, 2017 in exchange for consideration paid to the city of $100,000. Duke also is entitled to extend the agreement for up to six months at an additional payment of $4,878 per month for each month extended.
Standard Conditions such as protection of the City against liability, the orderly, safe and no unsightly use and restoration of the property at the end of the term are required of Duke Energy.
