Summary The review process for Voluntary Annexations is governed by Florida Statute 177.044. In order for an area to be annexed it must be contiguous to a municipality, be reasonably compact, and not create an enclave.
The subject property is located near the 13400 block of NW State Road 235, Tax Parcel Numbers 03130-008-000, 03130-009-000, portions of Tax Parcel Numbers 03130-004-000 and 03130-007-000, and a Parcel of land as described in O.R.B. 4564, PG. 460 of the Public Records of Alachua County. . The property is approximately 0.95 acres, and has an Alachua County Future Land Use Map designation of Rural/Agriculture and Zoning designation of Agriculture.
In compliance with F.S. 171.044 (5), a copy of the notice, via certified mail, was sent to the Alachua County Board of County Commissioners on January 11, 2018, not fewer than 10 days prior to publishing the ordinance notice. Per F.S. 177.044 (2), the notice was published for two (2) consecutive weeks, February 1, 2018 and February 8, 2018, in the Alachua County Today newspaper prior to the first hearing. Per F.S. 177.044 (2), the notice was published for two (2) consecutive weeks, February 15, 2018 and February 22, 2018, in the Alachua County Today newspaper prior to the second and final hearing. Mailed notices were also provided to property owners within 400 feet prior to both readings of Ordinance 18-04.
The Alachua County Growth Management Department has indicated that the County has no outstanding concerns with the application.
Section 1.7.7 of the City's Land Development Regulations indicates that if lands are annexed into the City, the lands shall retain their current unincorporated zone district classifications until a Future Land Use Map Amendment and change to the Official Zoning Atlas to City classifications has been adopted, and no development, redevelopment or expansion shall be initiated on the lands until such amendments have been adopted.
At the February 12, 2018 City Commission meeting, the Commission voted in favor of approving Ordinance 18-04 by a vote of 4-0.
