SUBJECT:  Dedication of NW 163rd Lane Extension

RECOMMENDED ACTION:

(1) Approve and accept the donation to the City by deed of the property described in the presented Special Warranty Deeds for the purpose of, and, by this action, dedicate such property as an extension of NW 163rd Lane and, (2) Authorize and direct the City Manager to hold all documents in trust pending receipt of the Publix signature page to the Removal document and, upon its receipt, record all documents.

 

Summary

The City Commission, at its regularly scheduled meeting on April 24, 2017, accepted donation and dedication of NW 167th Blvd between US 441 and the southern boundary of the Heritage Oaks subdivision along with that of NW 163 Lane running east from NW 167 Blvd to approximately 240 feet west of the west property line of Alachua County Tax Parcel No. 3053-1-9.

 

The presentation now before the Commission is to accept donation of two parallel parcels of approximately 240' x 26' (attached aerial view and highlighted in blue) one from Hipp Investments, LLC and the other from Alachua A One, LLC to extend NW 163 Lane from its current eastern terminus to the western boundary of Alachua County Tax Parcel No.3053-1-9. The identified tax parcel is a part of a large parcel currently under site plan review by the City and the NW 163 Lane extension before the Commission and the subject of this presentation is designed to be extended, as described, as a part of the new proposed development.

 

The developer and owner of the proposed new development, Alachua A One, LLC,  has agreed, as one condition of site plan approval, to, in addition to donation of the parcel described in this agenda item, pay all costs of constructing the presented right of way extension improvements. A Department of Economic Development Community Development Block Grant has been awarded to the City in an amount equal to about 50% of those costs and the developer is required to pay the balance.

 

The two parcels here described as donated by "Hipp" and "Alachua A One" are subject to Master Declaration and Restrictive Easement and Restrictive Covenant Agreements as members the Gateway Center association. It is necessary, therefore, for all ten property owners to agree to the removal of both donated parcels from the restricting encumbrances. Nine property owners, including the current title holders of the subject properties, have signed the attached removal document as of the date of preparation of this Agenda Item and Publix has assured the City the document will be delivered prior to the April 9, 2018 scheduled meeting.
