SUBJECT:  Request for One-Time Extension of Six-Month Moratorium for the Location of Wireless Communication Facilities Authorized by Ordinance 18-02

RECOMMENDED ACTION:

Based upon the presentation of staff, the City Commission finds there is a basis for the one-time six month extension as authorized in Ordinance 18-02 and the City Commission hereby authorizes this six-month extension of Ordinance 18-02.

Summary

On January 8, 2018 the City Commission adopted Ordinance 18-02, which establishes a six (6) month moratorium related to the location of small wireless facilities within the public rights-of-way. The moratorium was precipitated by a new state law effective July 1, 2017.  Ordinance 18-02 provides for a one-time extension of six months with approval from the City Commission.  Staff finds that additional time is needed to evaluate the implications of the new law and determine how small wireless facilities within the public rights-of-way will be addressed by the City.  The moratorium would be effective until December 8, 2018 with the proposed extension.
