SUBJECT:  Ordinance 18-17; Second Reading; Voluntary Annexation by Rodney & Deidra Smith,James Corey & Judith Lake-Corey and Floyd Tillman , Tax Parcel Numbers 03990-013-000, 03990-012-000, 03990-011-000, 03990-010-000, 03990-009-000, 03990-001-000, 03990-014-000, 03990-000-000, 03990-003-000 and 03990-003-001.

RECOMMENDED ACTION:

Adopt Ordinance 18-17 on second and final reading.

 

Summary

The review process for Voluntary Annexations is governed by Florida Statute 177.044.  In order for an area to be annexed it must be contiguous to a municipality, be reasonably compact, and not create an enclave.

 

The subject property is located 19722 NW 94th Ave, northeast of the intersection of NW 94th Ave and NW 202nd Street.  The property is approximately 352.22 acres, and has an Alachua County Future Land Use Map designation of Rural/Agriculture and Zoning designation of Agriculture. 

 

In compliance with F.S. 171.044 (5), a copy of the notice, via certified mail, was sent to the Alachua County Board of County Commissioners on February 28, 2018, not fewer than 10 days prior to publishing the ordinance notice.  Per F.S. 177.044 (2), the notice was published for two (2) consecutive weeks, June 14, 2018 and June 21, 2018, in the Alachua County Today newspaper.  Mailed notices were also provided to property owners within 400 feet.

 

The Alachua County Growth Management Department indicated that an enclave would be created because of two parcels located adjacent to the property subject to the original application. Since the original submittal,the applicant has indicated that the owners of the parcels (03990-003-000 and 03990-003-001) have  agreed to join in with the application. However, at the time of preparation of this agenda item, only two of the three parcel owners have signed the annexation application. If the last parcel owner provides the required signature prior to first reading, there will no longer be any concerns regarding an enclave being created.

 

Section 1.7.7 of the City's Land Development Regulations indicates that if lands are annexed into the City, the lands shall retain their current unincorporated zone district classifications until a Future Land Use Map Amendment and change to the Official Zoning Atlas to City classifications has been adopted, and no development, redevelopment or expansion shall be initiated on the lands until such amendments have been adopted. 

 

On June 25, 2018, the City Commission voted 5-0 to approve this Ordinance on first reading.
