SUBJECT:  Correspondence to Alachua County Regarding Tobacco Related Ordinance

RECOMMENDED ACTION:

Provide direction to the City Manager on the issuance of correspondence to Alachua County as it relates to the proposed tobacco related ordinance.

 

Summary

The Alachua County Board of County Commissioners is considering the adoption of an ordinance that will raise the minimum age to purchase tobacco products in Alachua County from 18 to 21.  The ordinance would also establish a tobacco retail license.  The draft ordinance (attached) proposes to make the regulations effective within both the unincorporated and incorporated areas of Alachua County with the municipalities having the option to opt out of inclusion.

 

The City Commission received a presentation on Sept. 24, 2018 regarding this matter.  The presentation (attached) did not make reference to an opt out provision being recommended or considered.

 

This matter was discussed during the City Commission meeting on Nov. 5, 2018 during Commission Comments/Discussion section. The Board of County Commissioners discussed the matter during its Oct. 23, 2018 meeting.  Staff has confirmed with Alachua County its intent to consider the adoption of the ordinance with an opt out provision in lieu of an opt in provision.

 

The Administration is requesting direction from the City Commission regarding sending a letter from the Mayor, on behalf of the City Commission, to the Board of County Commissioners with a position on the opt out provision.
