Summary Duke Energy Florida, L.L.C., is in the process of rebuilding and upgrading its existing distribution facilities in and about the City of Alachua. Duke Energy requires the use of temporary equipment and material storage facilities from Jan. 1, 2019 through and including March 31, 2019 and may require an extension of the use for one to three months.
The City and Duke have previously identified, and Duke has rented, City owned Tax Parcel 05949-008-000 for a non exclusive similar use at a monthly cost of $2,500.00 per month. The vacant 8.71 acre parcel is fenced and immediately south of the electric substation parcel near the above ground water storage facility at the southern terminus of NW 104th Terrace (see Exhibit A of the Attached Agreement).
The same language and terms of the prior rental agreement, except for an increase in the monthly payment, are used in this instance. The prior monthly payment is here increased from $2,500.00 to $3,000.00 rounded to $10,000.00 for the initial term due to the short duration of this Agreement.
Standard Conditions such as protection of the City against liability, the non exclusive, orderly, safe and no unsightly use and restoration of the property at the end of the term are required of Duke Energy.
Further, staff, in the interest of efficiency, asks the City Commission to authorize the City Manager to grant further extensions of the Agreement on the same terms and conditions for up to an additional six months. |
