SUBJECT:  Intergovernmental Conflict Resolution Process with Alachua County relating to Ordinance 18-15; Proposed Joint Planning Area Interlocal Agreement

RECOMMENDED ACTION:

Approve the Joint Planning Area Interlocal Agreement Between Alachua County and the City of Alachua and authorize the Mayor's signature.

 

Summary

The City Commission adopted Ordinance 18-15 on July 23, 2018, which voluntarily annexed property located at 5899 NW 93rd Ave.  The property is approximately 148.24 acres, and has an Alachua County Future Land Use Map designation of Estate Residential and Zoning designation of RE (Single Family, Estate Residential).

 

The Alachua County Board of County Commissioners, on Aug. 14, 2018, initiated the intergovernmental conflict resolution process, pursuant to Chapter 164, Florida Statutes in objection to the annexation of the property.

 

As part of the conflict resolution process, members of City staff and County staff held conflict assessment meetings to discuss the issues pertaining to the conflict.  The meetings resulted in what the respective staffs believe to be a tentative resolution.  To effectuate the resolution, a proposed Joint Planning Area Interlocal Agreement is presented to the City Commission for consideration.  Both the City Commission and Board of County Commissioners would have to approve the Agreement for it to be effective.

 

Primary Terms of Agreement:

 

  • Joint Planning Area established (map attached), defining boundaries for the Area.
  • 20-year term for the Agreement with automatic 20-year renewals.
  • County will not object to annexations by the City of properties located in the Area that fail to meet the strict requirements of Chapter 171, Florida Statutes regarding enclaves, contiguity, and compactness.
  • Portion of NW 93rd Ave. right of way and NW 59th St. right of way transferred from the County to the City for ownership and maintenance.
  • Mechanism established for the paying of future improvements to the intersection of NW 93rd Ave. and NW 43rd St. as a result of future development of properties within the Area.
  • Mechanism established for County to remit proportionate share of any impact fees (or equivalents) to City for future developments outside the Area that may impact rights of way owned or maintained by the City.
  • Coordination of fire, waste, law enforcement, utility services.
  • Concludes conflict resolution process

 

The County will consider the Agreement during its regular meeting on Dec. 11, 2018.
