SUBJECT:  Satisfaction and Settlment of Code Enforcement Lien - Tax Parcel 03390-000-000

RECOMMENDED ACTION:

Approve the Satisfaction and Release of Code Enforcement Lien concerning Tax Parcel No.03390-000-000, direct the Mayor to execute the document and, staff to deliver the executed document to Called to Action, Inc. for recording.

 

Summary

A City Code Enforcement Order was entered on February 4, 2002 ordering the payment of costs and fines in the amount of $1,799.87 by R.A. Bruck, the Owner of Alachua County Tax Parcel 03390-000-000 (street address of 13906 NW 145 Ave., Alachua, FL). The Order came about after a finding of Code Violations and City Clean Up of the described residential parcel. The Order was recorded in the Public Records of Alachua County at OR Book 2421 Page 982 thereby creating a Lien of Record against the person of Mr. Bruck, any other property owned by him in Alachua County, specifically, the described parcel (Attachment 1 - Order Imposing Penalty/Lien).

 

Property Tax Certificates were sold over a number of years due to the nonpayment of taxes ultimately resulting in the issuance of a Tax Deed to one Kirk P. Reeb on April 18, 2008 upon his payment of $8,000.00 pursuant to state law (Attachment 2 - Tax Deed). City Code Enforcement staff contacted Mr. Reeb, discussed current violations including the unkempt premises and dilapidated and dangerous building on site .

 

Mr. Reeb agreed and did bring the property in compliance, including obtaining the proper permit and demolishing and removing the non conforming structure, Mr. Reed then donated the property to Called to Action, Inc.(CTA) a Florida Not for Profit Corporation that has been determined by staff to be a tax exempt entity formed in 2011 to help provide affordable housing opportunities and otherwise assist those in need. (Attachments 3 - Call to Action Special Warranty Deed, Corporate Status and Tax Exempt Status).

 

CTA has  asked the City to Satisfy and Release the City Code Enforcement Lien (Attachment 4) so that on the property can be constructed a single family affordable housing unit. Staff finds the request has merit and consistent with Goal 4 of the Strategic Initiatives (support affordable housing options) adopted by this City Commission.
