SUBJECT:  Ordinance 19-16, Second Reading; Large Scale Comprehensive Plan Amendment: A request by Rodney and Deidra Smith, Tillman Little Farm, LLC, James Corey and Judith Lake-Corey, property owner, to amend the Future Land Use Map (FLUM) Designation from Agriculture (Alachua County) to Agriculture on a ±354.07 acre subject property. Consisting of Tax Parcel Numbers 03990-013-000, 03990-012-000, 03990-011-000, 03990-010-000, 03990-009-000, 03990-001-000, 03990-014-000, 03990-000-000, 03990-003-001 and portions of 03992-010-010 and 03992-010-011. (Legislative Hearing)

RECOMMENDED ACTION:

Based upon the presentation before the Commission and Staff's recommendation, adopt Ordinance 19-16 on second and final reading.

 

Summary

The proposed Large Scale Comprehensive Plan Amendment (LSCPA) is a request by Rodney and Deidra Smith, James Corey and Judith Lake-Corey, Tillman Little Farm, LLC, property owners, for the consideration of a Large Scale Comprehensive Plan Amendment (LSCPA) to the City of Alachua Future Land Use Map (FLUM), to amend the FLUM of the subject property from Rural/Agriculture (County)  to Agriculture on the ± 354.07  acre subject property The subject property is comprised of Tax Parcel Numbers 03990-013-000, 03990-012-000, 03990-011-000, 03990-010-000, 03990-009-000, 03990-001-000, 03990-014-000, 03990-000-000, 03990-003-001 and portions of  03992-010-010 and 03992-010-011. The subject property is located north of NW 94th Ave, east of NW 202nd Street, and west of NW CR 235.

 

The subject property was annexed through Ordinance 18-17 (adopted July 23, 2018) and is a part of a group of annexations for which the application fee to be annexed had been waived (Resolutions 17-11 and 17-19).  Through Resolution 18-03, the City Commission had also waived application fees for Comprehensive Plan Amendment and Rezoning applications for those properties annexed through the fee waiver resolution. This fee waiver was conditioned upon an application being received for a Future Land Use map amendment and rezoning amendment to  a City designation comparable to the existing Alachua County designation. 

 

The subject property presently has a Rural/Agriculture (County) FLUM Designation. The proposed amendment would change the FLUM Designation to Agriculture, a comparable City Future Land Use Designation. The Agriculture FLUM Designation permits a density of .2 dwelling units per acre (a maximum of 70 dwelling units for the subject property); the Rural/Agriculture (County) Land Use permits .2 dwelling units per acre (a maximum of 70 dwelling units for the subject property).

 

At the January 8, 2019 Planning and Zoning Board hearing, the Board voted 5-0 in favor of forwarding the Large Scale Comprehensive Plan Amendment to the City Commission with a recommendation to approve. 

 

At the February 11, 2019 City Commission hearing, the Commission voted 4-0 to approve Ordinance 19-16 on first reading and authorized City Staff to submit the application to the Florida Department of Economic Opportunity under the Expedited State Review process.

 

In accordance with Chapter 163.3184(3(b)1., Florida Statutes, the City submitted the proposed Comprehensive Plan Amendment to the following agencies: The Florida Department of Environmental Protection; the Florida Department of Transportation - District 2; the Florida Department of State; the North Central Florida Regional Planning Council; the Department of Economic Opportunity, Bureau of Economic Development; the Suwannee River Water Management District; the Department of Education; Alachua County; the School Board of Alachua County; the City of Gainesville; and the City of High Springs. As of March 28, 2019, The City received correspondence from the following agencies: DEO, Florida Department of Environmental Protection (FDEP), Florida Department of Transportation (FDOT), the North Central Florida Regional Planning Council. There were no objections raised or comments offered by these agencies regarding this application.
