SUBJECT:  Appointment of Code Enforcement Special Magistrate

RECOMMENDED ACTION:

Appoint Michael D. Durham as Special Magistrate and authorize the Mayor to execute the presented contract.

 

Summary

Section 12-20 of the City Code of Ordinances provides that the City Commission appoint a Special Magistrate to hold hearings and assess fines against violators of municipal codes and ordinances.  The previous Special Magistrate,  Jeremy Primosch, was appointed by the City Commission in 2015 and served as Special Magistrate until 2018.

 

On April 22, 2019, the City issued a Request for Proposal (RFP 2019-01) for Code Enforcement Special Magistrate Services.  Two proposals were received.   A Selection Committee Meeting was held on May 28, 2019.  The Selection Committee reviewed the proposals and interviewed both candidates. The candidate recommended for appointment is Michael D. Durham, an attorney who is Florida Bar Certified as a Specialist in City, County and Local Government Law, and has previously served in law enforcement and as a code enforcement officer.

 

The letter of application and resume of the candidate are made a part of this agenda item.

 

The proposed contract is consistent with Chapter 12 of the Code of Ordinances, which addresses Code Enforcement and the Special Magistrate, as amended by Ordinance 19-32.
